This privacy policy (“Privacy Policy”) applies to all visitors, users, and customers of the Helo website and services (collectively, the “Website” or "Websites" or “Service” or “Services”), which are offered by Helo Ehlo LLC and/or any of its subsidiaries and/or affiliates (“Helo” or “we” or “us” or “our”) and describes how we process your personal information in accordance with the Service.

What information Helo collects and why

Information you provide to us

When you sign up for the Services, contact us, or interact with the Service, you may provide us with personal information such as: 

  • Contact Information, such as name, email address, mailing address, or phone number;
  • Demographic information, such as age, education, gender, interests and zip code
  • Billing Information, such as credit card number and billing address;
  • Unique Identifiers, such as username, account number or password;
  • IP address;
  • Information about your business, such as company name, company size, business type.

If you do not provide this information, we will not be able to provide the Services to you.

Information you provide to us about your customers, end users, and contacts

For the provision of our Services to you, you provide us with information which may identify your customers, end users or employees. Such information includes:

  • Email addresses;
  • IP addresses;
  • Content of emails sent through Helo

You may also provide us personal information about your contacts such as name and email address where we can send receipts of your purchases. When you provide us with personal information about your contacts we will only use this information for the specific reason for which it is provided. If you believe that one of your contacts has provided us with your personal information and you would like to request that it be removed from our database, please contact us at the contact information below.

Information we collect automatically

Like most website operators, Helo automatically collects:

  • Technical information about your device including your device’s internet protocol (IP) address
  • Information about your visit to our Websites (the referral URL, the content viewed, and the content interacted with)

Some of this information is collected using cookies and related technologies. We collect this information to better understand how visitors use our Websites, to improve our Websites and experience for visitors, and to monitor the security of the Websites.

Helo allows PostHog to use these technologies to analyze trends, administer the Website, track user’s movements around the website, and to gather demographic information about our user base as a whole for the purpose of analytics. 

You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our website or service. We do not use, or allow the use of cookies or similar technologies in connection with your customers' data.

Information we collect from other sources

We may collect limited personal data from third-party services to evaluate potential senders and prevent abuse, fraud, and spam on our platform. We may additionally collect data from third-party sources and publicly available platforms to help identify potential customers, enhance our business contact database, and support our sales and marketing efforts.

Information we do not collect

Helo does not knowingly collect information from or direct any of our Websites or content specifically to children under the age of 18. If you are under 18, please do not use the Service and do not provide any personal information to us. If we learn or have reason to suspect that a customer is under the age of 18, we will terminate that account. If you become aware that a child under 18 has provided us with personal information without your consent, please contact us at the information below. 

Purpose and lawful basis for processing your personal information

To the extent EU data protection law applies to our processing of information about you, we act as the "data controller". To the extent EU data protection law applies to our processing of your customer or end user data, you serve as the "data controller" or "data processor" and we serve as the "data processor" or "data sub-processor".

To fulfill our contract with you

We use your information to identify you, process your payment, provide you with technical support and assistance; and communicate with you about the Services. For example we will contact you to notify you of any issues with the Services or any suspicious activity in your account. The legal basis for these uses is in the performance of the contract with you.

For our legitimate interests 

We use your information to authenticate you, prevent fraud and abuse of our Services, and perform research. The legal basis for these uses is our legitimate interest in the improvement and optimization of our service offerings and in ensuring the security of our services and we apply appropriate safeguards to protect your information.

With your consent

Where we send you marketing communications or use cookies that are not strictly necessary, we rely on your consent. You can withdraw consent at any time—for marketing, use the unsubscribe link in any email; for cookies, adjust your browser settings.

How Helo shares and protects your information

Helo does not sell, rent, or trade your personal information to third parties. 

We share information with service providers, as required by law, and in connection with the protection and enforcement of our legal and contractual rights. 

Service providers and partners

Helo engages a number of trusted third-party service providers and partners to manage or support certain aspects of our business operations. This includes: payment processing, providing customer service, sending marketing communications (this does not include information about your customers), conducting research and analysis, and providing cloud computing infrastructure. The legal basis for sharing this information is our legitimate interest in providing our Services efficiently and we implement measures to safeguard your information.

Examples of the service providers and partners we currently use include:

  • Amazon Web Services (AWS): cloud hosting
  • Stripe: payment processing
  • Slack: internal communications tool
  • Google Workspace: internal collaboration tool
  • PostHog: analytics tool
  • Help Scout: customer support tool

This list is meant to be representative and not exhaustive. We may engage additional or different service providers and partners over time as we see fit to support our business needs.

Public Authorities or Law Enforcement

In certain situations, Helo may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We may also disclose your personal information as required by law (such as to comply with a subpoena or other legal process), when we believe in good faith that disclosure is necessary to protect our rights, when we believe there is a violation to our Terms of Service (see Helo Terms of Service), to protect your safety or the safety of others, to investigate fraud, to respond to a government request, if we are involved in a merger, acquisition, or sale of all or a portion of our assets, or if we are involved in a bankruptcy or liquidation proceeding. The legal basis for this is our legitimate interest in protecting our legal rights and those of others, compliance with legal obligations and our legitimate interest in fulfilling legal obligations imposed by legal authorities outside of the EU.

Preventing fraud and abuse of the Services 

We will share information to prevent or detect fraud or to address technical issues and if we believe it is necessary to investigate, prevent, or take action regarding situations that involve abuse of the Services infrastructure. The legal basis for this is our legitimate interest in maintaining the security of our Services.

Helo takes measures reasonably necessary to protect your personal information against any unauthorized access, use, alteration, or destruction.

Helo may process and share information in an aggregated, de-identified manner, where the information is shared as part of a statistical report and does not contain personal information. 

Helo ​​may use the name and logo of companies using our products or services for promotional and marketing purposes, unless otherwise agreed to in writing. If you would like to opt out of or restrict such use, please email support@helohq.com.

Cookies and tracking technologies

Cookies

A cookie is a string of information that a website stores on a visitor's computer, and that the visitor's browser provides to the website each time the visitor returns. Helo uses cookies to help Helo identify and track visitors, their usage of the Websites, and their Website access preferences. Helo visitors who do not wish to have cookies placed on their computers may set their browsers to refuse cookies before using the Websites. Disabling browser cookies may cause certain features of Helo’s websites to not function properly.

Do Not Track

Helo does not track your online browsing activity on other online services over time and we do not permit third-party services to track your activity on our site. Because we do not share this kind of data with third-party services or permit this kind of third-party data collection for any of our users, and we do not track our users on third-party websites ourselves, we do not need to respond differently to an individual browser's Do Not Track setting.

Data retention and deletion

We may retain your information for as long as your account is active or as needed to provide you services, comply with our legal obligations, resolve disputes and enforce our agreements. In certain circumstances we may be required by law to retain your personal information, or may need to retain your personal information in order to continue providing a service.

Even if you delete your account, keep in mind that the deletion by our third party providers may not be immediate and that the deleted information may persist in backup copies for a reasonable period of time.

International transfer of data

Helo is based in the United States. The Websites are hosted in the United States, and the personal information we collect about our customers' users will be stored and processed on our servers in the United States. Information about our customers is processed in the United States by us, and may be processed elsewhere by the service providers and partners that we use to manage and support our business. Our service providers, employees, contractors and affiliated organizations that process information for us as described above may be located in the United States or in other countries outside of your home country which may have different data protection standards to those which apply in your home country.

Helo will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your personal data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

California privacy rights (CCPA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA):

  1. Right to know: You can ask us what personal information we have about you, including the categories of information collected, the sources, the purposes, and the third parties we share it with. 
  2. Right to delete: You can ask us to delete the personal information we hold about you, and we will direct our service providers to do the same. 
  3. Right to opt out of sale: We do not sell or rent your personal information to third parties. 
  4. Right to non-discrimination: We will not discriminate against you for exercising any of your CCPA rights.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. To exercise your California privacy rights, contact us at the information below. 

You may only make a verifiable consumer request for access or data portability twice within any 12-month period. The verifiable consumer request must: (a) provide sufficient information that allows us to reasonably verify that you are the individual about whom we collected personal information or that you are an authorized representative of that individual; and (b) describe your request with sufficient detail to allow us to properly understand, evaluate and respond to it. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Although most changes are likely to be minor, Helo may change this Privacy Policy from time to time, and at Helo's sole discretion.

We may also provide notification to customers who have provided us email addresses of material changes to this Privacy Policy by sending an email or by displaying a notice through our Websites or products, or otherwise. Helo encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of any of the Websites after any change in this Privacy Policy will constitute your acceptance of such change and acknowledgement of the updated Policy.
